Toss Australia Terms and Conditions


These Terms and Conditions (this Agreement) apply to the Toss App and the Services (as defined in Section 2.2 herein) provided by Toss Australia Pty Ltd (ABN 39 688 041 956) (the Company) through the Toss App. This Agreement sets out the rights and obligations between you and the Company and shall form a part of your agreement with the Company.


CHAPTER 1 – The Toss App


1 Getting started

1.1 Your agreement with the Company

This Agreement sets out the terms and conditions on which the Company provides the Toss App and the Services to you. You should carefully read these Terms and Conditions, along with the Company's Privacy Policy available at https://service.au.toss.im/terms/10000024.

By downloading the Toss App, and using the Services, you confirm that you accept and agree to these Terms and Conditions in their current form as made available on the Company's website or in the Toss App. If you do not accept these Terms and Conditions, or agree to comply with them, you must immediately stop using the Toss App and the Services.

1.2. Downloading and using the Toss App

You can download the Toss App from the Australian Apple App Store or the Australian Google Play Store. The availability of the Toss App on such platforms will be governed by the rules of Apple App Store or Google Play Store (as applicable).

To download, access and use the Toss App, you will need:

internet access;

an electronic device (for example, a mobile or tablet) with an operating system that meets the minimum requirements the Company sets from time to time; and


1.3 User registration

To use the Toss App and the Services, you must register with the Company. You can do this when you first open the Toss App by following the prompts in the Toss App.

To complete your user registration, you must provide the Company with certain information about you (such information, Registration Information). The Company may also be required by law to conduct certain user verification on you (e.g., security and customer due diligence checks). You hereby (i) consent to the Company performing such user verification on you and (ii) grant the Company the permission to use your Registration Information to perform any user verification.

The Company, acting reasonably, is not obliged to approve your user registration and may, at its sole discretion, reject or delay any user registration process. Among others, the Company may subject a registration application for further review:

if the information you have given to the Company is false, misleading, inaccurate or otherwise insufficient;

if you do not meet the Company's eligibility criteria;

if you are already registered with the Toss App; 

if your user status has been temporarily or permanently suspended or if you were previously registered with the Company and the Company cancelled your user registration or restricted your access to the Services;

if the Company reasonably believes or has reason to believe that the name provided by you on the user registration is not your name;

if you attempt to register under a corporate name or on another person's behalf; or

in circumstances where approval is not possible due to other reasons attributable to you (for example, bypassing VPNs or performing abnormal operation systems upgrades).


1.4 User Eligibility - who can use the Toss App and the Services

To be eligible to apply for user registration, you must:

be at least 18 years of age; 

have the legal right and ability to enter into a legally binding agreement with the Company;

agree to use the Toss App and the Services in accordance with these Terms and Conditions;

and not have had your Toss account previously suspended or terminated.

You must only use the Toss App and the Services:

for personal purposes; and 

on your own behalf (and not on behalf of someone else). 

You must not permit other people to access or use the Toss App or the Services on your behalf. 

1.5 Changes to the Toss App and the Services

The Company may require you to update your electronic device's operating system, update the Toss App or switch to a new app to continue to access and use the Toss App and the Services. If you do not do this, the Company can suspend or stop your access to, or use of, the Toss App and the Services. 

The Company can, at its sole discretion and without any consent, make changes and updates to Toss App and the Services from time to time (for example, the Company may make improvements or add new features or products and services), as well as this Agreement. See Section 14 for more information about the changes the Company may make to these Terms and Conditions, the Toss App and the Services.


CHAPTER 2 – The Services


2 Accessing and using the Services

2.1 Linking an Eligible Account

In order to use one or more of the Services, you must link at least one Eligible Account to the Toss App other than a Toss Rewards account. You can link an Eligible Account by following the prompts in the Toss App and providing the requested consents. You are authorised to link multiple Eligible Accounts. 

2.2 What Services are available

Once you have linked an Eligible Account, the following services may be available to you under the Toss App (collectively, the “Services”):

Financial Dashboard Service: This service allows you to see a consolidated view of your Linked Accounts and provides you with insights about your Linked Accounts.

Payment Transfer Services: This service allows you to transfer money from a Linked Account to another Australian bank account using PayTo.

Toss Rewards: This service allows you to earn rewards upon completion of certain activities within the Toss App. 


2.3 Fees and charges

There are no fees or charges payable by you to the Company in connection with the access to or use of the Services.

However, the financial institution who has provided you with the Linked Account may charge you a fee for a transaction in connection with that account.

2.4 Additional services

From time to time, the Company may make additional services available to you. Upon launch of such additional services, the Company may request that you agree to additional terms and conditions and/or complete additional user registration process (e.g., consents or user verification) before you can access and use the additional services. For any additional service the Company launches, the Company reserves the right to limit your access to any additional service unless you (i) agree to the applicable additional terms and conditions and (ii) complete the applicable additional user registration process.


3 Financial Dashboard Service

3.1 About this Service

The Financial Dashboard Service provides you with a consolidated view of your Linked Accounts, featuring transaction and account data, to provide you with an overview of your financial assets across your Linked Accounts.

3.2 Understanding the amounts and features in the Service

The amounts displayed under the Financial Dashboard Service are sourced from the third parties you have authorised to relay your information pursuant to the Consumer Data Right regime. These third parties have not reviewed or endorsed the Toss App or the Financial Dashboard Service. The Company does not control the data that it receives and does not guarantee that the account balance shown in the Financial Dashboard Service is correct. You should contact the applicable third party for any questions you have about the account balance related to your Linked Account.

The Financial Dashboard Service is for general information purposes only and is not intended to be financial, accounting or other professional advice. The Company cannot guarantee that the account balance and other details displayed in Financial Dashboard Service will always be accurate.


4 Payment Transfer Service

4.1 About this Service

The Payment Transfer Service allows you to transfer money from a Linked Account to another account with an Australian financial institution using PayTo in accordance with a PayTo Agreement established in connection with the Linked Account.

4.2 Setting up the PayTo Agreement

To use the Payment Transfer Service in connection with a Linked Account, you must set up a PayTo Agreement for that Linked Account. Your financial institution will require you to authorise the PayTo Agreement. If you do not do this, you will not be able to use the Payment Transfer Service.

4.3 How to make a transfer using the Payment Transfer Service

Each time you want to use the Payment Transfer Service to transfer money from a Linked Account to another account, you must follow the prompts in the Toss App to complete the payment instructions, including specifying the amount you want to transfer from your Linked Account to the nominated payee and their account details (for example, their BSB and account number or PayID).

You can transfer money only to an account held with an Australian financial institution through the Payment Transfer Service. 

4.4 Minimum Sufficiency

It is your responsibility to ensure that you have sufficient funds in your Linked Account to allow a payment to be made in accordance with the PayTo Agreement and your payment instructions.

If there are insufficient funds in your Linked Account, you may overdraw your Linked Account or the transaction may be declined or not processed. 

4.5 Managing the PayTo Agreement

You may cancel your PayTo Agreement for a Linked Account:

by contacting the Company – see Section 15.1 for more information on how to contact the Company; or

by contacting your financial institution.


4.6 Misdirected or unauthorized payments 

There may be times when a transfer from a Linked Account using the Payment Transfer Service is made to a person you did not intend to pay (for example, you entered the wrong payee details) (each such payment, a “Misdirected Payment”), or a transfer has occurred that you did not authorise (for example, if someone steals your electronic device or PIN) (each such payment, an “Unauthorised Payment”). Upon your discovery of Misdirected Payment or Unauthorised Payment, you should contact the recipient to directly to resolve the issue (if possible). You can also ask your financial institution to raise an enquiry with the recipient's financial institution on your behalf in an attempt to recover the funds.

4.7 Liability for misdirected or unauthorized payments

The table below sets out when you or the Company will be liable, and to what extent, if something goes wrong with the Payment Transfer Service:

You entered the wrong account or other details (including the PayID identifier) when using the Payment Transfer Service.
You are liable.
A payment from your Linked Account was made using the Payment Transfer Service without your authorisation and (A) you acted fraudulently, or (B) you intentionally or with gross negligence failed to keep your electronic device or PIN secure as required under the Agreement. 
The Company is not required to reimburse you for your loss as a result of the unauthorised transaction (that is you will bear the loss) except to the extent that any part of the loss was a result of the Company acting fraudulently or with gross negligence (to that extent, the Company bears the loss).
A payment from your Linked Account has been made using the Payment Transfer Service without your authorisation as a result of the Company or its service providers (Company’s employees and agents) acting fraudulently or with gross negligence.
The Company shall be liable for the amount debited from your Linked Account without your authorisation, as a result of the Company or its service providers (Company’s employees and agents) acting fraudulently or with gross negligence; provided, however, that the Company shall not be responsible for any loss attributable to your acts of fraud or negligence. 
A payment from your Linked Account was made using the Payment Transfer Service without your authorisation and the row above does not apply.
You are liable for the loss; however, if the Company, in its sole discretion determines, that the unauthorised payment was caused because of the Company’s security issue and you have notified the Company of such security issue, the Company shall be responsible for losses incurred after your notification of the security issue to the Company.


The Company may require you to provide a proof that a payment was not authorised by you.


4.8 Safely using the Services

You should only use the Payment Transfer Service to send money to friends, family and trusted and verified businesses and third parties that are known to you or that you have already done business with. 

You should not send money to the recipients whom you do not know and have never dealt with before.

4.9 Maximum amount you can transfer using the Payment Transfer Service

The Company may apply a threshold limit to the use of the Payment Transfer Service, either on per transaction basis or in aggregate amount as a whole within a certain period of time.


5 Toss Rewards

5.1 Earning rewards

You will earn, and the Company shall grant, rewards points in connection with your participation in eligible activities. The Company, in its sole discretion, may determine (i) the activities eligible for earning reward points and (ii) to whom the Company shall grant such reward points 

Reward points are only valid for two years from the date they are earned. Eligible activities are subject to change from time to time at the sole discretion and policy of the Company.

5.2 Withdrawing rewards points

To withdraw any earned rewards points, follow the prompts in the Toss App while transferring rewards points to a Linked Account. 

5.3 Circumstance when you may not receive rewards points

The reward points may not be credited or may be reclaimed:

if the Company determines you are in breach of this Agreement;

if the Company decides to discontinue or cancel Toss Rewards (including the termination of the Toss App); or

if the Company suspends your access to the Toss App or any of the Services.


5.4 Reducing your reward points balance

If an event or circumstance described in Section 5.3 applied and the Company nonetheless has credited reward points to you, the Company can reduce your reward points balance that it credited to you. This may result in a reward points balance becoming negative.

If a reduction would cause your reward points balance to become negative, the Company can instead restrict or suspend your ability to earn future reward points up to an equivalent value of the reduction.

Points may be reduced even after termination of this agreement, and in such an event the resulting negative balance may be applied upon re-registration.

5.5 Cancelling reward points not yet transferred

The Company may cancel reward points that have been earned at any time if:

the Company discontinues or cancels Toss Rewards (including the termination of the Toss App), 

the Company terminates this Agreement;

the Company suspends your access to the Toss App or the Service;

you cancel your user registration;

the Company reasonably believes you have breached the Agreement or engaged in abusive, fraudulent, or other improper conduct; or

the rewards have not been transferred to a Linked Account or used within 2 years of being earned.


CHAPTER 3 – General Provisions


6 Restrictions on using the Toss App and Toss Services

You must not misuse the Toss App or Services. Misuse of the Toss App or the Services includes, among others, engaging in, facilitating or attempting to do any of the following:

breaching applicable laws or regulations (including by using the Toss App or Services for any illegal or prohibited activities or conduct);

sending or receiving funds suspected to be fraudulent or misappropriated or otherwise engaging in fraud or fraudulent conduct;

engaging in any act that intentionally interferes with the normal operation of the Service, including providing false, misleading, or inaccurate information to the Company (including by using third-party information to open an account or when using a Service);

trying to bypass account restrictions, to deal in harmful programs such as viruses, spyware, or similar computer code designed to adversely affect the operation of any computer software or hardware, or to otherwise interfere with the operation of the Toss App;

accessing the Toss App or using the Services from [Restricted Countries];

infringing the Company’s or any third party's intellectual property rights;

taking actions that could disrupt the Company’s relationships with service providers or third parties;

abusing any dispute resolution processes;

refusing to reasonably assist the Company (including by not verifying your identity when requested); and

engaging in defamatory, threatening, harassing, harmful or abusive behaviour, or behaviour that otherwise does not comply with any content standards or policies of the Company.


7 Stopping access or use of the Toss App or a Service

7.1 Termination by you

You can cancel your user registration at any time by following the steps in the Toss App. 

Once your user registration is cancelled, this Agreement is terminated and you will not be able to access the Toss App or the Services. If you want to access the Toss App and the Services at a later time, you will need to apply for user registration again through the Toss App.

Notwithstanding the foregoing, you must complete all ongoing transactions using the Services provided by the Company prior to providing notice of termination, ensuring that no further claims or liabilities remain to be processed through the Services.

If the Company determines a user’s repeated voluntary termination and re-registration poses a risk of abusing the benefits or economic interests provided by the Company, the Company may restrict such user from re-registration.

Upon termination of this Agreement, the Company may invalidate or reclaim any benefits (including Toss Rewards) provided to you.

7.2 Suspension by the Company for cause

The Company may restrict or suspend your access to or use of the Toss App or the Services (in whole or part) for any of the following reasons:

if you repeatedly enter incorrect personal authentication methods such as your PIN;

if the Company receives notification that your account has been compromised, or otherwise determines that you are unable to keep your account secure;

if you attempt to use the Services or the Toss App, or access the Company's system, in a manner that is not permitted under this Agreement or in contravention of the Service use manual provided by the Company;

if you use the Services or the Toss App to engage in fraudulent activity, including but not limited to misrepresenting or using another person’s name, card information, account information, or any other identifying or financial information without authorisation;

if you intentionally or recklessly interfere with the Services, the Toss App or the Company's operations;

if you infringe upon the legitimate interests of other users of the Toss App;

if you breach, or the Company believes that you have breached, the Agreement or any law;

if you attempt to engage in suspicious or abnormal transactions;

if you misappropriate, store, disclose, or use for improper purposes any information held by the Company;

if the laws of Australia or another country, a regulatory authority or sanctions require the Company to do so;

if the Company finds that (a) you have engaged or may engage in money laundering or financing of terrorism or (b) you are not the actual owner or beneficiary of your account.

Where your account is restricted or suspended, the Company will use reasonable efforts to provide notice to you of the reason for the action. However, in the following cases, the Company may restrict or suspend your account without prior notice:

if there is an urgent need to protect the legitimate interests of the Company or other members; 

if there is a reason to believe considerable risk of fraud or security breach; or

in case of an Event Outside the Company's Control.

Where your access has been suspended or restricted, and you have provided the Company with information to reasonably satisfy its concerns which gave rise to the relevant suspension or restriction, the Company will use reasonable endeavours to re-instate access as soon as practicable.

7.3 Termination by the Company for cause

If the Company has reason to believe that any of the events or circumstances listed in Section 7.2 above have occurred, and the event or circumstance by its nature is material (or the Company reasonably considers that it has had a material impact, or is likely to have a material impact on, the Company, the Toss App, the Services, you, the security of the Company or the Company's legal or reputation risk), the Company may immediately terminate the Agreement and remove your access to the Services.

7.4 Termination by the Company without cause

The Company may terminate this Agreement, revoke your user registration, or discontinue the provision of any Services by providing you with at least thirty (30) days’ prior notice.


7.5 Our responsibility for loss or damage

7.6 Our liability is limited

Except for any liability that cannot be excluded by law (including the Non-Excludable Guarantees) and as provided for under Section 4.7, the Company is not liable to you for any loss or damage, including any indirect, special, or consequential loss (including, without limitation, loss of profits or revenues (actual or anticipated), or otherwise resulting from your use of the Toss App or the Services), arising as a result of the following (except to the extent that loss or damage is caused by the Company's fraud, negligence, wilful misconduct, or that of the Company's employees, agents, officers, contractors, administrators, or receivers):

any failure by the Company to perform (in part or full), or delay in the performance of, any of its obligations under the Agreement due to its compliance with any laws or regulations;

suspension of the Toss App or the Services resulting from maintenance and upgrades to its systems or the systems of any party used to provide the Toss App or the Services;

any disruption caused by a malfunction of all, or any part of, the technology the Company uses to provide the Toss App or to perform its Services;

any unauthorised access to the Toss App or the Services (including any use of the Services);

any disruption caused by any period when all, or any part of, the Toss App or the Services are unavailable;

any loss or corruption of any data stored or held (including, but not limited to, copies of any documents related to a transaction or your identity) by the Company (or a service provider acting on its behalf);

payments made using the Services (including, for example payments which may result in an account being overdrawn) or transaction any transactions that are delayed, blocked, frozen or refused by a financial institution;

defective digital content the Company provides to you where the damage could have been avoided by you applying an update provided by the Company, or by you not following its installation instructions or failing to have in place the minimum system requirements advised to access and use the Toss App or the Services;

any virus, or other malicious software or technological issues or attacks or harmful material that may infect your computer equipment, computer programmes, data or other proprietary material related to your use of the Toss App or the Services;

any Third Party Websites and the use of any Third Party Materials;

any inaccuracy, error or delay in, or omission from, any information provided to you;

any delays, failures, or inaccuracies in the transmission of any information to you, or any other communications;

the occurrence of an Event Outside the Company's Control; and 

any dispute between you and any other person.

7.7 You are liable if you breach this Agreement or applicable laws 

In the event of loss, claims, costs, or expenses (including reasonable legal fees) arising out of your breach of this Agreement, any applicable law or regulation and/or your use of the Toss App or the Services, you agree to defend, compensate the Company and its affiliates and hold it harmless. This provision shall survive the termination or expiration of this Agreement.


8 Security and authentication

8.1 Authentication 

In order to access and use the Toss App, you must perform the authentication procedure required by the Company and register a PIN during the user registration application process. Registered PINs can be changed via the Toss App. 

8.2 Protecting your login details

Your account contains sensitive financial and personal information which can be accessed through the Toss App. In order to keep your account and information safe, you must take the following precautions:

use strong PINs that are not obvious or cannot be easily guessed;

exercise sufficient caution, including by regularly changing your PIN and not using it for other accounts;

do not reveal your account PIN to anyone (whether deliberately or recklessly);

do not keep a record of your account PIN on your mobile device;

ensure your personal information and account information remains correct and up-to-date; and

do not allow other people to access or use your account. 


8.3 If you suspect your security has been compromised

You must contact the Company immediately, if you suspect that:

your device or the Toss App has been compromised, or accessed by a third party without your consent; or 

your device, the Toss App or the Service login details or credentials have been stolen, lost or used by a third party without your consent. 

If you suspect your security has been compromised, you should also change your PIN immediately. This can be done via the Toss App.

If you forget or lose your PIN, you may reset it through re-authentication using your linked CDR bank account information or by verifying your identity with your ID card via the Toss App.

8.4 Responsibility for loss or damage

Before the Company receives any notification from you pursuant to Section 8.3, you will remain solely responsible for any actions, omissions or instructions that arise in connection with the Toss App, the Services and your mobile device.

8.5 Fraud

In addition to personal authentication methods such as PINs, the Company operates a separate Fraud Detection System to detect unauthorised use. To detect fraudulent transactions, the Company may use information entered or generated by members while using the Toss App. 

If a suspected fraudulent transaction is detected, the Company may immediately suspend your use of the Toss App or a Service (including services provided by affiliates and partners within the Toss App) or take other measures as determined by the company and require you to undergo additional authentication as determined by the Company. 

While transactions may be restricted based on reports from other member, the Company reserves the right to impose sanctions determined by it in the event of abusive reporting.


9 Access to the Toss App or a Service may not always be available

There may be times when the Toss App or a Service (or a feature or function of them) is not available (for example, this may occur when there are scheduled outages or due factors outside the Company's control such as your issues with your internet connection or phone or emergency maintenance). It is your responsibility to check the Toss App for details of scheduled outages.

The Company does not guarantee that the Toss App and the Services will always be available or uninterrupted. You should take this into account in time-sensitive circumstances, such as when you need to make a payment by a particular date or time. 

The Company will endeavour to provide reasonable advance notice to you (which may be by notice on the Toss App) about any planned interruptions to the Toss App.


10 Privacy

You acknowledge that the Company may collect your personal information in order to facilitate use of the Toss App. Any personal information that the Company collects through the Toss App will be treated in accordance with its Privacy Policy which is available to view on the Company's website or within 'Settings' in the Toss App. The Company's Privacy Policy may change from time to time.


11 Intellectual property rights

Unless otherwise stated, the Company owns, or is duly licensed by third parties to use, all rights, title, and interest in and to the Toss App and all materials made available through it (including, without limitation, all text, graphics, logos, audio, software, designs, patents, trademarks, and other intellectual property rights) (collectively, the “Content”).

Your use of the Toss App and use of and access to any Content does not grant or transfer any rights, title or interest to you in relation to the Toss App or the Content. However, the Company does grant you a licence to access the Toss App and view the Content in accordance with these Terms and Conditions and, where applicable, as expressly authorised by the Company and/or its third party licensors.

Any reproduction or redistribution of the Content is prohibited and may result in civil or criminal penalties. In addition, you must not copy the Content to any other server, location or support for publication, reproduction or distribution is expressly prohibited. 

All other use, copying or reproduction of the Content or any part of it is prohibited, except to the extent permitted by law.


12 Third party links and materials

The Toss App may contain links to other websites which are operated by third parties which likely have their own terms and conditions of use (Third Party Websites) and provide you access to information, products, services, and other materials by third parties (Third Party Materials). Any links within the Toss App are provided “as is” and for your convenience and information purposes only and do not constitute an endorsement, approval or recommendation of any Third Party Materials made available on the Third Party Websites.

Accessing a Third Party Website is done so at your own risk. Except to the extent required by the Consumer Law, the Company makes no warranty or representation as to the quality, accuracy, completeness, currency, functionality or fitness for purpose of any Third Party Materials contained on Third Party Websites.

If you have any queries or issues regarding Third Party Websites or Third Party Materials, you should contact the third party responsible for the relevant Third Party Website.


13 Taking action for regulatory reason

The laws of Australia or other countries, regulatory authorities or sanctions may require the Company to do things which may affect your ability to access or use the Toss App and the Services. If the Company considers it necessary, it can delay, suspend, stop, block, end or refuse to provide the Toss App or a Service to you. The Company may not (and may not be allowed to) notify you before it exercises any of these rights. The Company is not liable for any loss you incur because it exercises any of these rights.

You agree to provide the Company with any information it reasonably requires to assist it in complying with the above compliance processes.


14 The Company can make changes

14.1 Types of changes the Company can make

The Company can change these Terms and Conditions (including documents and things referred to in them) or the Services without your consent, including: 

changing, adding, removing features, products and services and updating them;

to reflect legal or regulatory requirements;

to simplify the Agreement or make it more helpful to you;

to reflect the way the Company's business is run, particularly if the change is needed because of a change in the way any financial system or technology is provided;

to reflect changes in the cost of running the Company's business; or

it is administrative or minor or corrects an error, inconsistency or omission; or 

because of security reasons.


14.2 Notifying you about changes

The Company does not have obligation to notify you about a change to these Terms and Conditions or its Services before it makes any changes, such change may be needed in order to immediately restore or maintain the security of the Toss App or the Services or to protect you or the Company from loss. The Company will notify you about these changes after it makes them.

Otherwise, the Company will notify you of any changes as follows:

If the Company reasonably considers the change has a positive or neutral effect on you – no later than the day the Company makes the change.

If the Company reasonably considers the change is unfavourable to you – at least 30 days' notice before the Company makes the change.


Notwithstanding the foregoing, the Company may give you less notice if it is reasonably necessary to manage a material and immediate risk.

Such notice of implemented changes will be provided to you in the Toss App or by any other reasonable means pursuant to this Section 14.2

If you do not like a change the Company makes, you can stop using the Toss and the Services and you can cancel your user registration by contacting the Company. If the Company does not hear from you during the notice period, you will be considered as having accepted the proposed changes and they will apply to you from the effective date specified in the notice.


15 Communications

15.1 How to contact the Company

You can contact the Company on global-support@toss.im

15.2 How the Company will contact you

You agree that the Company may contact you and inform of various issues by making notifications or sending messages in the Toss App. You will be considered to have received the communication the day the Company sends it or makes it available on the Toss App. 

You agree that the Company may also contact you and tell you about things by mobile phone, email, text or push notification. You will be considered to have received it on the day the Company sends the notification to your mobile number, email address or via the Toss App. 

The Company relies on the information you give it via the Toss App. You must keep your information up to date.


16 Information you provide the Company

All information you provide to the Company must be complete, accurate and not misleading and must be in a format acceptable to the Company. You must update this information whenever it changes. The Company is not responsible for any loss arising out of your failure to do so. The Company may ask you at any time to confirm the accuracy of your information or provide additional supporting documents.

If the Company asks, you must provide the Company with further information it reasonably requests from you. You agree that the Company may make, directly or through any third party, any inquiries the Company consider necessary to validate the information you provided to it. 


17 Severability

The Agreement is to be read on the basis that any term which is illegal, void or unenforceable at law, does not comply with a law, or imposes an obligation or confers a right prohibited by law, is omitted or varied to the extent necessary to comply with that law.


18 The Company's right to enforce the agreement

The rights of the Company under this Agreement are in addition to, and do not exclude or limit, any rights or remedies available to it under applicable law. The Company may exercise its rights in any manner it reasonably deems appropriate, including by imposing conditions on any consent, approval, or waiver. Failure or delay in exercising any right, power, or remedy under this Agreement does not constitute a waiver of that right, power, or remedy, and the Company may exercise it at any time thereafter.


19 Assignment

You may not transfer, assign, mortgage, charge, subcontract, declare a trust over or deal in any other manner with any or all your rights and obligations under the Agreement without the Company's prior written consent. 

The Company can transfer, assign or novate the Agreement (or any right or obligation under it) at any time without your consent.


20 Governing law

This Agreement is governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales, Australia and any courts of appeal from them.

22 Defined terms and interpretation


Under this Agreement, the following terms have the meanings set forth below unless otherwise stated:

Agreement means the agreement entered into between you and the Company on these Terms and Conditions.

Company means Toss Australia Pty Ltd (ABN 39 688 041 956).

Consumer Data Right (CDR) means the regime established under the Competition and Consumer Act 2010 (Cth), the Competition and Consumer (Consumer Data Right) Rules 2020 (Cth), and any related legislative instruments, regulations, or standards made under or in connection with that regime. The CDR provides consumers with a right to access certain data held by data holders and to direct that such data be shared with accredited data recipients. For the purposes of this Agreement, references to the CDR include all obligations, rights, standards, and guidelines issued by the Australian Competition and Consumer Commission (ACCC), the Office of the Australian Information Commissioner (OAIC), and Data Standards Australia (DSA), as amended or replaced from time to time.

Consumer Law means, as applicable, the Competition and Consumer Act 2010 (Cth) or the Australian Securities and Investments Commission Act 2001 (Cth).

Content has the meaning given in Section 11.

Eligible Account means an Australian dollar account held in your name with an authorised deposit-taking institution (as defined under the Banking Act 1959 (Cth)) (ADI) in respect of which there is data that the Company would be permitted to collect, handled and/or disclosed under the Consumer Data Right regime. 

Event Outside the Company's Control means any event or circumstance beyond the Company's reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary. It includes, without limitation, such events or circumstance as strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, natural disasters, failure of telecommunications network and internet disturbances (including where you are not in an area of mobile coverage).

Linked Account means an Eligible Account you have linked to the Toss App.

Non-Excludable Guarantees means the statutory consumer guarantees as provided under the Consumer Law, as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia.

Payment Transfer Service means the service that allows you to transfer money from a Linked Account to another account with an Australian financial institution using PayTo.

Financial Dashboard Service means the service that allows you to see a consolidated view of your Linked Accounts and provides you with insights about your Linked Accounts.

PIN means a six-digit numerical code, or other equivalent authentication method (such as biometric authentication including Face ID or Fingerprint recognition provided by your device’s operating system), which you set and use in the Toss App for the purposes of authentication, identification, transaction approval, withdrawal of Toss Points, or electronic signature (or similar) in relation to your use of the Service or Toss App. 

Privacy Policy has the meaning given in Section 10.

Restricted Countries means FATF blacklisted country, UNSC/Autonomous sanctioned country, Toss self-designated sanctioned country.

Services means the Financial Dashboard Service, the Payment Transfer Service, Toss Rewards.

Terms and Conditions means these Toss Australia Terms and Conditions, as varied or supplemented from time to time.

Third Party Materials has the meaning given in Section 12.

Third Party Websites has the meaning given in Section 12.

Toss App means the Company's mobile application software, the data supplied with the software and the associated media.

Toss Rewards means the rewards service provided by the Company in the Toss App that allows you to receive rewards points after completing certain activities.

VPN means a virtual private network.
